Welcome to PeakDesk. By accessing or using our service, you agree to be bound by these Terms of Service. Please read them carefully. If you don't agree with these terms, please don't use our service.

1. Acceptance of Terms

By creating an account or using PeakDesk, you agree to these Terms of Service and our Privacy Policy. These terms apply to all users of the service, including organizations and individual users.

2. Description of Service

PeakDesk provides remote monitoring and management (RMM) services for workstations, including:

  • Automated device monitoring and health checks
  • Security patch management
  • Compliance tracking and reporting
  • AI-powered issue detection and prevention
  • Technical support and assistance

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice to users.

3. Account Registration and Security

To use PeakDesk, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 18 years old or have parental consent
  • Represent a legitimate business or organization
  • Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.

4. Subscription and Billing

Free Trial

We offer a 7-day free trial for new customers. No payment is required during the trial period. Your subscription will automatically begin after the trial ends unless you cancel.

Pricing and Payment

  • Subscription fees are billed monthly or annually based on your selected plan
  • Prices are per workstation/device managed
  • All fees are non-refundable except as required by law
  • We may change our pricing with 30 days' notice
  • You authorize us to charge your payment method for all fees

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will continue to have access to the service until that date.

5. Acceptable Use Policy

You agree not to:

  • Use the service for any illegal or unauthorized purpose
  • Violate any laws or regulations
  • Interfere with or disrupt the service or servers
  • Attempt to gain unauthorized access to any part of the service
  • Use the service to transmit malware or harmful code
  • Reverse engineer or attempt to extract source code
  • Resell or redistribute the service without authorization
  • Use the service to monitor devices you don't own or have permission to manage

6. Data and Privacy

Our collection and use of your data is governed by our Privacy Policy. By using PeakDesk, you:

  • Grant us permission to collect and process device data as described in our Privacy Policy
  • Represent that you have the right to provide us with access to the devices you manage
  • Acknowledge that we may use aggregated, anonymized data to improve our service
  • Understand that you retain ownership of your data

7. Intellectual Property

The service, including all content, features, and functionality, is owned by PeakDesk and is protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, or create derivative works of the service
  • Use our trademarks or branding without permission
  • Remove or alter any copyright or proprietary notices

8. Service Level and Availability

While we strive to provide reliable service, we do not guarantee:

  • Uninterrupted or error-free operation
  • That the service will meet all your requirements
  • That all issues will be detected or prevented

We may perform scheduled maintenance with advance notice. Emergency maintenance may occur without notice.

9. Limitation of Liability

To the maximum extent permitted by law:

  • PeakDesk is provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid us in the past 12 months
  • We are not responsible for data loss (you should maintain backups)
  • We are not liable for third-party services or integrations

10. Indemnification

You agree to indemnify and hold PeakDesk harmless from any claims, damages, or expenses arising from:

  • Your use of the service
  • Your violation of these terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

11. Termination

We may suspend or terminate your account if you:

  • Violate these Terms of Service
  • Fail to pay fees when due
  • Engage in fraudulent or illegal activity
  • Pose a security risk to the service or other users

Upon termination, your right to use the service immediately ceases. We will delete your data within 90 days unless required to retain it by law.

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by email or through the service. Your continued use of the service after changes take effect constitutes acceptance of the new terms.

13. Governing Law and Disputes

These terms are governed by the laws of the United States. Any disputes will be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class action lawsuits.
